Terms of Service

By accessing or using DeploysApp ("the Service"), operated at deploysapp.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

"We", "us", and "our" refer to DeploysApp, operated by Miszterek Fix Kft. (registered seat: 2600 Vác, Dózsa György út 68. 2a, Hungary; VAT: 27810929-2-13). "You" and "your" refer to the user of the Service.

DeploysApp is a cloud hosting platform that allows users to deploy, manage, and scale web applications, APIs, databases, and background services using Docker containers. The Service includes:

• Application building and deployment from Git repositories or Docker images
• Automatic HTTPS/SSL certificate provisioning
• Custom domain management and DNS hosting
• Email hosting and transactional email sending
• Database provisioning (PostgreSQL, MySQL, MongoDB, Redis)
• Domain registration (via third-party registrar)
• A web dashboard and API for managing all of the above

To use the Service, you must create an account with a valid email address and verify it. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. Accounts are for individual use unless you are on a plan that supports team collaboration.

You agree not to use the Service to:

• Send spam, bulk unsolicited emails, or phishing messages
• Host or distribute malware, viruses, or malicious code
• Conduct denial-of-service attacks or network abuse
• Mine cryptocurrency or run computationally abusive workloads
• Store or distribute illegal content, including child exploitation material
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to other users' services or data
• Violate any applicable local, national, or international law
• Reverse-engineer, decompile, or attempt to extract the source code of the platform

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

The Service offers multiple billing plans with different resource limits (number of services, build minutes, storage, email sending quotas, etc.). You agree to:

• Operate within the limits of your selected plan
• Pay all applicable fees on time via our payment processor (Stripe)
• Accept that exceeding plan limits may result in service restrictions

Free tier: The free plan is provided as-is with no guaranteed uptime or support. We may modify free tier limits at any time.

Paid plans: Billing is monthly and recurring. You may upgrade, downgrade, or cancel at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months.

We strive to maintain high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any damages resulting from service interruptions or downtime.

You retain full ownership of all code, data, and content you deploy on our platform. We do not claim any intellectual property rights over your content.

You grant us a limited license to host, run, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your content or account.

You are responsible for maintaining backups of your data. While we take reasonable precautions, we are not liable for data loss.

If you use our email hosting or email sending API, you additionally agree to:

• Only send emails to recipients who have consented to receive them
• Include a valid physical address or unsubscribe mechanism in marketing emails
• Comply with CAN-SPAM, GDPR, and all applicable anti-spam regulations
• Not use our email services for phishing, spoofing, or fraud
• Maintain bounce rates below 5% and complaint rates below 0.1%

Violation of email policies may result in immediate suspension of email services.

We may suspend or terminate your account if:

• You violate these Terms of Service or our Acceptable Use Policy
• Your usage poses a security risk to the platform or other users
• Your payment is overdue for more than 14 days
• Required by law or legal process

Where possible, we will provide notice before suspension. Upon termination, your data will be retained for 30 days to allow retrieval, after which it will be permanently deleted.

To the maximum extent permitted by law, DeploysApp and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

You agree to indemnify and hold harmless DeploysApp from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Hungary. Any disputes arising from these Terms shall be resolved in the courts of Hungary.
